TOPIC/SPEAKERS: The topic will be the “Reality of Residential Lending and Credit Practice” to further a discussion some of our members had at our September 2010 meeting. Weldon Burton , CPA and Jeff Bannan of Vancouver Mortgage who is a twenty year plus local mortgage broker will explain this dynamic area while dispelling the myriad of myths circulating in our community. Terry Lee has been generous enough to facilitate this topic.

Congrats to Kristen Parcher

The FLS would like to offer congratulations to Kristen Parcher, a former FLS member, who has been appointed as a new District Court Commissioner!

The Family Law Section had their annual holiday meeting last month. The meeting was entertaining and offered an opportunity for our members to bond over poking fun of their colleagues; all in fun of course!

Some of the awards given include a harmonica for Dean Langsdorf so he can sing the blues in Court; marbles for Bob Vukanovich not because he lost his but because he’s the guy everyone wants to play with at the playground; the Vancouver Gevurtz Menashe members received maps of Clark County and armor to protect them from their new colleagues here in Clark County; a large to heart was given to Jolene Sell to honor her ability to manage with heart; a remote control for Judge Collier so he can use the mute button (or parties may use the mute button on him); and even Santa received an award…a cash register from Commissioner Schienberg to can keep track of all the fees he orders.

The next FLS meeting will be Thursday, January 13, 2011 from 11:30 a.m. to 1:00 p.m. at Tommy O’s and will be on the topic of “Reality of Residential Lending and Credit Practice” to further a discussion some of our members had at our September 2010 meeting. YWCA SafeChoice Needs Volunteers

What: The YWCA SafeChoice domestic violence legal clinic needs
volunteer attorneys to assist survivors of domestic violence with
divorce and/or custody issues. This is an opportunity for attorneys to
provide immeasurable help to domestic violence clients and to support
the work of SafeChoice advocates who provide counseling, housing
assistance, support and education to domestic violence clients.

When: 2nd and 4th Mondays of the month from 6pm to approximately 8:30pm
(frequency of attendance is up to the volunteer attorney)

FLS November Meeting

CCBA FLS – NOVEMBER 11 MEETING – GUEST SPEAKER CATHERINE SMITH AND VALERIE VILLACIN


SPEAKERS: Catherine Smith and Valerie Villacin will join us from King County for our November meeting. They will discuss family law appeals in general, standards of review, reasons to appeal, what types of issues are likely to get some traction, and strategies for dealing with appeals as a respondent. They will incorporate some discussion to satisfy an ethical credit as well.

WHEN: The meeting will be Thursday, November 11, 2010 from 10:30 a.m. until 1:00 p.m. We will take a half hour break for lunch from 11:30 a.m. to 12:00 p.m. to eat lunch.

The November 11 meeting falls on Veteran’s Day. Most of the family law attorneys will be working that day so after discussion with the speakers and some members, I decided to go ahead with the meeting. This is in no way intended to take away from the appreciation for our veterans and the sacrifices they made to keep our country free.

October 14 Meeting Info

CCBA FLS – OCTOBER 14 MEETING – GUEST SPEAKER KARL TEGLAND


SPEAKER: I am honored to announce that Karl Tegland will be joining us at our October 14 meeting. He will discuss evidence and family law.

If you do not know who Mr. Tegland is, he is the author/co-author of sixteen volumes of West's Washington Practice, including the Courtroom Handbook on Washington Evidence and the Washington Handbook on Civil Procedure. Mr. Tegland also writes and publishes Tegland's Litigation Today, a monthly newsletter for Washington judges and practitioners. Since 1980, more than 880 Washington appellate opinions have cited Mr. Tegland's work as authoritative.

WHEN: The meeting will be Thursday, October 14, 2010. Because Mr. Tegland will be here, this meeting will be a little longer than usual and will offer two CLE credits rather than one. The meeting will be from 11:00 a.m. – 1:00 p.m. Mr. Tegland will speak from 11:00 a.m. to 12:30 p.m. and will take questions from 12:30 p.m. to 1:00 p.m.

There will not be social time per usual at the beginning of the meeting and the presentation will start promptly at 11:00 a.m. so I recommend arriving at about 10:45 a.m.

WHERE: The lunch meeting will be held at the Red Lion at the Quay.

LUNCH: Lunch will be plated and served and will include rolls with butter; Caesar salad; either pasta primavera with garden vegetables or grilled chicken with marinara over penne pasta with steamed vegetables; and cookies for dessert.

AFCC (Association of Family and Conciliatory Courts) is presenting a two day advanced training program on child custody, in collaboration with the Missouri Chapter of AFCC and the University of Missouri at Kansas City School of Law. The training will be held at the UMKC School of Law in the E.E. "Tom" Thompson Courtroom, Kansas City, Missouri, September 30-October 1, 2010. Advanced Issues in Child Custody: The Child's Perspective, September 30-October 1, 2010, presented by Mindy F. Mitnick, Ed.M., M.A., will focus on strategies for improving your ability to understand and present the voice of the child to parents and to professionals working with families living apart. Participants will learn about improving the reliability of information obtained from children by conducting developmentally sensitive interviews, using language children can understand, following a continuum of suggestiveness in questions and using a flexible protocol.

I’m looking forward to kicking off the 2010 - 2011 year! There’s no better way to kick of the year than with a presentation from our family law judicial officers.

SPEAKERS/TOPIC: We are lucky to have Judge Rulli; Judge Collier; and Commissioner Stahnke who will present “Special Advice from the Bench” for our members. The bench will discuss a potpourri of issues and will take questions. You can always email me confidential questions in advance.

WHAT/WHERE: The meeting will be Thursday, September 9, 2010 from 11:30 a.m. – 1:00 p.m. at the Family Law Annex in courtroom #3. The meeting is BYOL (Bring Your Own Lunch).

FLS - Year in Review - Recap

As a reminder, the forms to join the CCBA and FLS are going out in the next edition of Hearsay. Remember, you have to be a member of the CCBA to be a member of FLS.

Last year we had a great membership turnout so don't let me down this year! The CCBA membership fee is $135.00 and the FLS membership fee is $25.00.

Next year, we will continue to meet every second Thursday of every month September through June. The location is still floating.

The 2009-2010 year was a lively one for the FLS. We have succeeded in attracting high numbers of attorneys to the meetings and many Commissioners and Judges attend as well. Our CLE presentations consisted of topics ranging from drug testing to bankruptcy to sex addiction. We have a new “Santa,” Commissioner Stahnke, to host our annual holiday awards meeting; we have a subcommittee working on creating an attorney work room at the Family Law Annex; and one of our members, Crystal Lambert, generously volunteered to recreate a Family Law Expert Book for our members.

I encourage people to continue checking the blog. I created the blog to keep members "in the know" about upcoming meetings, events, and announcements so that they are not reliant on the mass emails I send out. Invariably, someone does not receive the mass email due to security blocking, a typo, etc.

Mandatory Mediation Proposal Meeting, July 15

Thanks to everyone who attended our summer meeting to discuss the CCAM Mandatory Mediation proposal.

We had a lively discussion and we made some progress. Judges and members were able to share their reasons for supporting the proposal or their concerns about the proposal. Most of the questions and concerns are along similar lines.

A steering committee was formed to help with the proposal. I will keep in close contact with the steering committee so I can keep the FLS informed as to any changes or updates made.

WHAT/WHERE: We’re having a summer meeting! It will take place on Thursday, July 15, 2010 from 11:30 a.m. to 1:00 p.m. in the back room at Sunrise Bagels. Order and pay for your lunch at the counter in the main restaurant. Let them know that you will be in the back room for the meeting so they know where to find you.

SPEAKERS/TOPIC: Most of you read the CCAM Mandatory Mediation Proposal I emailed out last week. I received A LOT of feedback and for that reason feel that a meeting to discuss the proposal is appropriate. Mary Hatzenbeler and Meredith McKell Graff will be there to present the proposal and answer any questions.

Clark County Association of Mediators Proposal

The Clark County Association of Mediators has a proposal before the judiciary to make mediation mandatory for dissolution cases.

I will be meeting with Judge Poyfair, Meredith McKell Graff, and Mary Hatzenbeler, the two mediators behind the proposal, on July 29.

The judiciary would like the input of the Clark County Bar Association Family Law Section. The FLS doesn't have a meeting scheduled until September so I will be interviewing members of the FLS prior to July 29 so I can adequately represent the FLS at the meeting.

FLS SUMMER MEETING

Did you really think the FLS wouldn't have a meeting all summer?

I'd like to invite the FLS to a Clark County wine tasting adventure on Saturday, July 24, 2010 from 10:00 a.m. until about 4:00 p.m.

I'll rent a chauffeured bus that will hold everyone who RSVP's. We'll go to 3-4 wineries depending on the time. Typically the tastings and a tour are free for larger groups. We'll stop to have a catered lunch or lunch at a winery. These details will be better worked out when I have a head count. I am hoping to keep the cost from $50.00 - $100.00 per person.

The wineries will most likely include Bethany, Rusty Grape, and Three Brothers. I will send a detailed itinerary to those who RSVP yes prior to the trip.

FLS JUNE MEETING

The 2009-2010 CCBA FLS final meeting was on June 10, 2010 at Tommy O’s. The topic discussed was sex addiction and if it affects parenting. Dr. Kirk Johnson of the Vancouver Guidance Clinic and Maggie Holbrook of the Vancouver Police Department Cyber Crimes Unit were the presenters and they made an already interesting topic quite entertaining.

Since I have been President for one year, I chose to finish the two year term and remain the President for the 2010-2011 year. I am excited to continue as President and look forward to finishing the projects I started. Our new Secretary is Robin Krane and our new Treasurer is Laura Mancuso.

High on the agenda were discussions regarding a Family Law Annex attorney workroom. The FLS formed a subcommittee to look into the anticipated cost of a workroom with a computer and relevant software. If you have a computer, printer, or software to donate, please let me know. Once we have a general idea of the cost the FLS will vote on whether or not to use our funds for the workroom.

In case you didn’t read my previous column, Judge Rulli has been selected as Jurist of the Year by the Washington State Bar Family Law Section. Judge Rulli was recognized at the WSBA Family Law Section Mid Year CLE luncheon on June 19th, 2010. This award recognizes his 18 years on the bench, depth of knowledge and expertise in family law and his achievement at the primary architect of the Clark County Drug Court, a nationally recognized model.

If you are not a member of the CCBA FLS, you will not be able to vote next year! To be a member of the CCBA FLS you must be a member of the CCBA. The CCBA membership fee is $125.00 and the FLS membership fee is $25.00. The application forms will be included in the August 2010 newsletter.

One big issue for next year is our potential meeting location. If anyone has locations suggestions or topic ideas, please let me know. I will continue to update the FLS blog over the summer so keep checking in!

Last Meeting of the Year - June 10

The last FLS meeting of the year will be June 10.

The topic is “Sex Addiction: A Way Around the “No Fault” Barrier?” The speaker and location is TBD.

Scott Horenstein will give a case law update and we will be electing our new officers for the next year. If you are interested in being an officer, please let me know. We will also decide on how to use some of the FLS funds.

FLS Recap May's Meeting

Kathy McCann announced that Judge Rulli has been given the prestigious award of Washington State Bar Family Law Section Judicial Officer of the Year! Over 40 local family law attorneys signed a letter in support of Judge Rulli!

Our sections Treasurer, Kristen Parcher, gave a treasurer’s report. The section voted to sponsor the CCBA annual barbeque this year! Next month the section will be voting on how to use the remainder of the funds. Options include various donations, contributions to the CCBA for their help with the FLS, and speakers to educate or train the group on specialties of the law. Please let us know if you have any suggestions on how to use our funds!

MAY 2010 FLS MEETING TOPIC


You do not want to miss our next meeting! All the family law Judges and Commissioners will sit as a panel and give us “Practice Tips from the Bench.”


The Judges and Commissioners have specifically requested that it be conducted as a panel discussion and that we have questions from family law attorneys submitted in advance.

The meeting will be held on May 13 from 11:30 a.m. until 1:00 p.m. at the Family Law Annex (NOT Hula Boy) and it is BYOL (Bring Your Own Lunch).

If you have specific questions you would like to submit anonymously in advance, please email them to me!

The cost to receive the lunch meeting CLE credit is $5.00 for members and $10.00 for nonmembers.

FLS APRIL 8 MEETING


CCBA FLS – April 8 MEETING

WHAT/WHERE: Our next meeting is Thursday, April 8, 2010 from 11:30 a.m. – 1:00 p.m. Please note the FLS meetings will now be held at Hula Boy which is located at 1109 Washington Street in downtown Vancouver.

SPEAKERS/TOPIC: We are excited to have Jolene Sell, Senior Deputy Prosecuting Attorney, and Marjorie Millner, Claims Officer from the administrative office of child support, as guest speakers. Ms. Sell will give us practice tips for drafting child support orders including common mistakes and Ms. Millner will talk about the administrative procedures in child support establishment and collection, the administrative role, and the expectation she has of attorneys regarding administrative hearings.

Because Tony Golik spoke to the group about his campaign at our last meeting, I extended an invitation to the other candidates for prosecutor to appear at our April meeting. Curt Wyrick has since dropped out of the race and I am still waiting to hear back from Brent Boger’s camp.

COST TO ATTEND: The cost to attend the lunch meeting is $10.00 for non-attorneys and attorneys who do not wish to receive the CLE credit. Attorney’s who want lunch and CLE credits are $15.00. Attorney’s who want lunch and CLE credit but are not a member of the CCBA FLS pay $27.00. If you do not RSVP, you pay $25.00 at the door. Judges, Commissioners, and speakers are always free of charge.

*Remember that if you overpaid for your lunch last month to deduct the amount you overpaid from your lunch this month.

CLARK COUNTY PROSECUTOR CAMPAIGN

At the FLS March 2010 meeting Tony Golik spoke to the group about his campaign for Clark County Prosecutor.

I had originally promoted Mr. Golik as a "speaker" prior to the meeting because that is what I understood him to be. A few days prior to the meeting, Mr. Golik and I realized that we had a misunderstanding and that he actually just wanted to speak about his campaign. Because I know that the FLS has an interest, I allowed him to speak about his campaign for five minutes.

To be fair, I have extended invitations to the other candidates for Clark County Prosecutor, including Brent Boger and Curt Wyrick, to speak for five minutes each at our April 2010 meeting.

The Clark County Bar Association Family Law Section's next meeting will be Thursday, March 11, 2010.


Commissioner Sonya Langsdorf, Deputy Prosecutor Tony Golik, and Sergeant K.C. Kasberg from the Clark County Sheriff's Office will speak to the group on the topic “Domestic Violence Order of Protection: When the Victim Strikes Back.”

TOPIC: Debtor/creditor specialists Don Thacker and Stanley Horak will speak to the topic:


“I Lost My Job, the House is Underwater, and I Want a Divorce!”

We will cover the issues that arise with dealing with financial crisis and home ownership in a divorce. This subject is broad and complex so if you have specific questions or issues you would like addressed feel free to let me know in advance.


COST TO ATTEND: The cost to attend the lunch meeting is $12.00 for non-attorneys and attorneys who do not wish to receive the CLE credit. Attorney’s who want lunch and CLE credits are $17.00. Attorney’s who want lunch and CLE credit but are not a member of the CCBA FLS pay $27.00. If you do not RSVP, you pay $25.00 at the door. Judges, Commissioners, and speakers are always free of charge.

Self Support Reserve Update


RCW 26.19.065(2)(b) provides that the basic support obligation of the parent making the transfer payment cannot reduce his/her net income below the self-support reserve (with certain exclusions and exceptions).

The self-support reserve is stated as 125% of the federal poverty level, which is generally adjusted every January based upon the prior year's Consumer Price Index.

The CPI decreased in 2009 (reportedly for the first time since the poverty guidelines began to be issued in 1965)! In December 2009, the President signed a law containing a provision extending the 2009 poverty guidelines until at least March 1, 2010.

Therefore, for now the self-support reserve remains at $1128 per month. Minimum wage in Washington also remains the same as in 2009 ($8.55 per hour).

Kalka

As some of you know, Kalkadora Thangkhiew’s husband, Amod, died unexpectedly on Wednesday. Kalka and Amod were close to many of us.

A service for Amod will be held this Sunday from 12:00 p.m. to 2:00 p.m. at Finley's at 6801 S.W. Sunset Highway (past the zoo). Their phone number is (503) 292-6654.

A "Celebration of Life" will be held at Kalka's home at 5:30 p.m. on Sunday. Her address is 3209 S.E. 173rd Court, Vancouver, WA 98683.

FLS JANUARY 14 MEETING INFO!

Our next meeting is Thursday, January 14, 2010 from 11:30 a.m. – 1:00 p.m. at Tommy O’s, 801 Washington Street, Vancouver, WA.


Judge Rulli and Scott Horenstein will explain the Supreme Court case, Estate of Borghi. I just received word that Judge Poyfair will be attending the meeting (and most likely commenting) as well.

Borghi gives new direction to the courts regarding characterization of real property that was owned prior to the marriage; but was subsequently placed in joint title.

An old case (Descamps) held that such transfers are not valid (in simple terms). Two later cases (Hurd and Olivares) said that those transactions create a gift presumption. In the Borghi case, the trial court held consistent with Hurt and Olivares. The Court of Appeals, citing Descamps, reversed and held the transfer to be invalid (reluctantly). The Supreme Court affirmed the Court of Appeals. The appellant has moved the Supreme Court for reconsideration and Scott was asked to file an amicus brief. The brief is attached.

Scott recently learned that the Supreme Court accepted the amicus which means they will consider it in the reconsideration process.

The class is held at Heart Connections on 305 W 16th Street, Vancouver, WA on Saturday, January 9th with registration beginning at 8:00 a.m. and class from 8:30 a.m. to about noon.

The class will address the legal, financial, emotional, and social aspects of divorce. Attorneys who would like to monitor the class are welcome to do so in preparation for teaching or recommending it to clients.

Save A Life -- From Dru Horenstein

On December 7, my 26 year old son who is now fine was saved by someone who was not afraid to help. He collapsed with sudden cardiac arrest at a gym while working out in Seattle. The assistant manager immediately did two things: called 911 and began chest compressions.

This is all you have to do when someone collapses like he did. You don’t need special training. All you need to do is two-handed chest compressions, at 100 a minute, hard and fast in the center of the chest until the paramedics come. This will keep the blood and oxygen flowing.

Please practice saying this right now: call 911, begin chest compressions, hard and fast in center of chest.
